The property described in the auctions published on Stamp-One is offered for sale either by internet auction or public auction or a combination thereof as stated in the introduction to the sale, by Cornerstamp, Inc. DBA Paradise Valley Stamp Company ("PVSC") as agent for various owners and itself or affiliated companies. By placing a bid on any lot, the bidder agrees to be bound by these Conditions of Sale.
- The purchase price payable by a buyer shall be the sum of the final bid (the last bid acknowledged by the auctioneer and usually the highest bid), together with any applicable sales tax or use tax. In auctions named “PARADISE LIVE” which have live internet bidding, a buyer’s premium of 12½ is added to the purchase price of each lot. Other sales conducted in the traditional mail auction manner, with no live bidding, do not have a buyer’s premium.
- The highest bidder shall prevail as determined by the auctioneer. In the event of a dispute between bidders the auctioneer’s decision is final as to determine the successful bidder, to continue the bidding or to re-offer and resell the lot in dispute. The auctioneer has the right to reject any bid or advance the bidding at his discretion. PVSC’s record of the final sale shall be conclusive.
- All bids are per lot as numbered in the listing unless otherwise announced by the auctioneer at the time of sale. PVSC will bid on behalf of clients, but will not be responsible for any errors in the execution of such bids.
- All lots are offered subject to a minimum bid. In some cases the auctioneer may have advanced proceeds to the seller and thus have a financial interest in the lot.
- Successful bidders, unless prior arrangement of credit has been made with PVSC, must make full payment for purchased lots before delivery is made. Mail bidders will be notified by mail or e-mail. Payment for purchased lots must be received by PVSC within fifteen days of the sale date. PVSC retains the right to demand cash payment at the time of the knock-down of any lot if PVSC in its sole discretion deems it appropriate. If the buyer refuses or are unable to comply with PVSC’s request for payment at the time of knock-down, PVSC reserves the right to immediately reoffer the lot to the highest bidder.
- If the purchase price has not been paid within the time limit, nor lots picked up within fifteen days from the sale date, PVSC reserves the right to resell the lot(s) by whatever means PVSC in its sole discretion deems appropriate, and any loss incurred from such resale will be charged to the buyer in arrears. Any account delinquent after thirty days from the sale date will be subject to a late payment charge of 2% per month as long as the account remains in arrears. Any costs incurred in securing payment for an account in arrears will be charged to the defaulting party.
- Any lot, except for those mentioned in this paragraph, subject to that the description is incorrect, is returnable, if the lot is returned within seven days of receipt and not later than thirty days after the date of sale. Such lot must be returned intact with its original packing material. The following lots may not be returned for any reason: Lots containing ten or more items; lots that have been viewed by the buyer either by mail or at PVSC’s pre-sale exhibition of lots, any lots described with faults or defects may not be returned for any fault or defect. Illustrations shall serve as guidance for the bidder as to an item’s appearance and such illustrated item can not be returned due to factors made obvious by the illustration such as, but not limited to, margins, centering and cancellation.
- All lots in the sale are sold as genuine unless otherwise stated. The purchaser of a lot may request the expert opinion of a third party authority subject to that such authority is known and accepted by PVSC, in its sole discretion, and the conditions of such extension requests listed in paragraph 9 below are fully complied with and, further, that the lot in question is not furnished with a certificate of authenticity dated within the past five years of the sale date.
- The purchaser who wishes to obtain a certificate of authenticity for any item that is not accompanied by a certificate dated within the past five years may do so provided the following conditions are met: (1) the lot must be fully paid for, (2) the lot must be submitted to a by PVSC acceptable expert or expertizing committee within three weeks of the sale date, (3) a copy of the application form must be submitted to PVSC, (4) the buyer upon receipt of the certificate must notify PVSC to clear the lot of extension (if written notification to the contrary is not received within 90 days of the sale date, the extension is presumed clear). In the event that a lot is returned, PVSC will refund the purchase price and the actual cost of the certification up to a maximum of $25.00.
- Any agent executing bids on behalf of clients is personally responsible for all purchases made on behalf of said clients.
- The buyer is responsible for all risk for delivery of purchased lots, as well as paying for shipping and insurance costs. Proof of mailing constitutes delivery.
- All lots remain the property of PVSC on behalf of the consignors until paid for in full.
- This agreement shall be governed and interpreted by the laws of the State of New Hampshire. By bidding in the sale the buyer has consented to the exclusive jurisdiction of the Superior Court of Merrimack County, New Hampshire and the Federal Courts of the United States of America located in the District of New Hampshire.
